Defective Motorcycles
Pennsylvania
does not currently have a Motorcycle Lemon Law. The good news
is that you still have a remedy if you have purchased a defective
Motorcycle in PA. There is a Federal Law called the
Magnuson
Moss Warranty Act that protects individuals who have purchased
defective Motorcycles.
The Magnuson Moss Warranty Act is very similar to the PA Lemon Law in many respects. If the Manufacturer cannot fix the problems with the bike, after being given a reasonable number of attempts, then the consumer is entitled to a full refund or free replacement Motorcycle of equal value, PLUS his Attorney Fees and associated costs.
The Magnuson Moss Warranty Act does not have mileage restrictions, like the PA Lemon Law, therefore it can be used on any Motorcycle that has a substantial problem or defect that the Manufacturer cannot fix, provided that the first occurrence of the problem happened while the bike was still under the Manufacturer's Original Warranty period, and the Manufacturer was notified of that defect.
