PA Lemon Law Myths
There are many misconceptions about the Pennsylvania Lemon Law, its
requirements, the remedies it provides, and the manner
in which claims are handled.
Myth: My vehicle has had three repair attempts for the same problem, so the Dealer has to give me a new vehicle.
Fact: The PA Lemon Law provides that the manufacturer must provide you with a full refund or free replacement if the vehicle suffers substantial defects that cannot be repaired within three attempts.
Myth: I need to file my claim within the first year or 12000 miles of use.
Fact: You merely need to place the manufacturer on notice that there is a problem with the vehicle that occurred within the first year or 12000 miles to be eligible for a PA Lemon Law claim. Notice can be placed by contacting a certified dealership and advising them of the vehicle's problem. In addition, if the vehicle's problem first occurs after 12000 miles of use, you may still be eligible to file a federal lemon law claim.
Myth: The dealer cannot find a problem, so I do not have a claim.
Fact: Not all problems occur every time your vehicle is at the dealership. Many of our client's claims involve what are called "intermittent" problems. These problems occur at random with no predictable nature or aspect to them. This does not mean that you do not have a claim!
Myth: I cannot afford an attorney to assist me with a Lemon Law claim.
Fact: This is the number one issue that the public is misinformed on regarding lemon law cases. Experienced Lemon Law attorneys do not charge retainers on these types of cases. They know that their fee will be paid by the manufacturer when the client wins the claim. Therefore, your attorney will be free, certainly so if you hire our law firm!
Myth: I have a used car, so I don't have a claim.
Fact: There are many other laws in Pennsylvania that protect used vehicle purchasers just like yourself. If the vehicle that you purchased had original manufacturer's warranty at the time of purchase, you may have a federal lemon law claim. If the vehicle had a dealer warranty, you may have a claim.
