THE PENNSYLVANIA LEMON LAW TEST (Remember, you only need to answer YES to one question to possibly have a Lemon!)
- Has your car or truck been to the Dealer for repair of the same defect at least three (3) times?
- Has your vehicle been at the Dealer for repairs for at least thirty (30) calendar days? (These do not have to be consecutive days, this means 30 days with all repairs added up).
- Has your Pennsylvania registered motor vehicle been to the Dealer for repair of a warranty covered item that was never properly fixed?
- Has the Dealer refused to repair your PA vehicle, or charged you for a repair that should have been covered under warranty?
- Has the Dealer advised you that they could not duplicate the problem that you have claimed exists with your automobile?
- Please note that the PA Lemon Law only applies to new vehicles; other laws such as the Magnuson Moss Warranty Act may provide relief to you on a newer "used" vehicle. We typically do not accept cases on vehicles where the manufacture date is more than five (5) years from the current date.
If
you answered NO! to the above
questions, you may have still have a claim! If you purchased
a car, truck, van, SUV, Motorcycle or other motor vehicle, new
or used, with original Manufacturer's warranty on it and a
defect arose while under that warranty, you may be able to bring
a claim under other Pennsylvania state statutes or the
Federal
Lemon Law.
